Introduction
In consideration of the services of Journeymen Institute, including all of their officers, directors, staff, leaders, co-leaders, volunteers, affiliates and all persons and entities acting for them or on their behalf (hereinafter collectively referred to as “Journeymen”), the right of myself, my child, foster child or adolescent youth of whom I have legal custody (hereinafter "Participant"), and the right of my Participant to engage in this Course or event (hereinafter “Course”), I hereby freely and voluntarily agree to release, indemnify, and hold Journeymen harmless on behalf of myself, my Participant, my children, my parents, my heirs, assigns, personal representatives and estate, as follows:
DISCLOSURE AND ACKNOWLEDGMENT OF RISKS
I understand that the Course is a personal growth and development course held primarily in an outdoor setting with additional exposure to urban, suburban, and/or wilderness environments and involves known and unanticipated risks which could result in physical or emotional injury, paralysis, death, illness, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. These risks include, among others:
The nature of this Course itself, which involves or may involve:
Strenuous and vigorous, physical, mental, emotional, and intellectual activity such as outdoor and indoor games during day or night, role playing (e.g. enactments of past events, feelings or parts of psyche or personality) and exercises and processes which may include or result in physical, mental or emotional stress, distress and fatigue (e.g. facing and overcoming physical, emotional or mental obstacles to the achievement of goals);
The potential for death; for injury to skeletal-neuromuscular system (such as strains, fractures, ruptures, bruises, loss of limb or loss of use of limb, paraplegia and quadriplegia), to internal organs, to cardiovascular system (such as elevated blood pressure, elevated pulse, heart attack, aneurysm, hemorrhage or stroke), to eyes or ears (loss of sight or hearing), to body (such as scrapes, scratches, punctures, lacerations) and to mental health (such as depression or re-traumatization relating to past psychological history);
Hazards associated with outdoor, camping and wilderness environments such as, but not limited to, “acts of nature” (rockslides, lightning, etc), adverse weather, interactions with wildlife; and
The potential for change with respect to such matters as: education, career, job or business; relationships with family, friends, youth, co-workers, and behavior in social, personal or school and business settings.
Additional risks include:
The acts or omissions of Journeymen who may, among other things, be ignorant of any participant’s fitness or abilities; misjudge the weather, the elements, or the terrain; or give inadequate instructions, warnings or advice.
Latent or apparent defects or conditions in the equipment or property supplied by Journeymen or other persons or entities as well as the use or operation of such equipment.
Acts of other participants in Course or other persons.
PARTICIPANT UNDERTAKINGS
I and my representatives expressly acknowledge, agree and promise to accept all of the risks existing in this Course, including those risks listed above as well as those risks not specifically listed above.
I and my representatives understand, acknowledge and represent that my and my Participant’s participation in Course and in every separate part thereof is purely voluntary and I authorize my Participant to participate in spite of and with full knowledge of all the risks. I acknowledge that at all times my Participant will be free to choose to leave the Course or to not engage in any part or all of Course.
I and my representatives hereby authorize Journeymen to take any and all reasonable steps on behalf of my Participant in the case of any physical or other injury, illness or condition my Participant might suffer during Course. Journeymen is hereby authorized to apply emergency first aid, engage physicians of any kind, nursing services, ambulance services, paramedic services, or any other service or personnel that in the sole discretion and judgment of Journeymen may be deemed reasonable and necessary for my Participant’s immediate care, health and safety.
I and my representatives hereby voluntarily release, forever discharge Journeymen and agree to indemnify and hold Journeymen harmless with respect to any and all liability, claims, demands, or causes of action and damages which arise out of, or are in any way connected with, my Participant’s participation in Course, my Participant’s use of Journeymen equipment or facilities, or the provision by Journeymen of emergency services, including but not limited to claims alleging negligent acts or omissions or medical malpractice.
I and my representatives additionally release and forever discharge any and all Course sites (“Venues”) and agree to indemnify and hold Venues harmless with respect to any and all liability, claims, demands, or causes of action and damages which arise out of, or are in any way connected with, my Participant’s participation in this Course, my Participant’s use of Venues’ equipment or facilities.
I agree and promise to indemnify and hold Journeymen harmless from all costs and liabilities incurred by Journeymen in connection with claims for personal injury or property damage to staff, other participants, volunteers, spectators or other third parties which arise out of, or are in any way connected with, my or Participant’s participation in Course.
I additionally agree and promise to indemnify and hold Venues harmless from all costs and liabilities, including but not limited to, attorney fees, incurred by Venues in connection with claims for personal injury or property damage to staff, other participants, volunteers, spectators or other third parties which arise out of, or are in any way connected with, my participation in this Course.
In signing this document I fully recognize and acknowledge that if anyone (including myself) is hurt or property is damaged, lost, or destroyed, as a result of my Participant’s participation in Course, I may be found by a court of law to have given up any right I might have to make a claim or file a lawsuit against Journeymen.
Should Journeymen or anyone acting on their behalf be required to incur attorney fees and costs in connection with any effort to enforce this agreement as a result of my Participant’s participation in Course, I agree and promise to indemnify and hold them harmless against all such fees and costs.
I certify that I have sufficient health, accident and liability insurance to cover costs and expenses of any injury or damage my Participant may suffer or cause while participating in Course. If I have no such insurance I agree to bear all the costs of any and all such expenses and liability.
I certify that I have completed the registration form(s) required by Journeymen, if provided; that I have disclosed each and every physical, emotional or mental condition for which my Participant has received treatment or is currently receiving treatment; that the information I have provided pertaining to my Participant’s physical, emotional or mental condition is complete and true; and that I have complied with the medical requirements of Journeymen. I further certify that my Participant has no medical condition which could interfere with their safety in Course and agree to assume and bear the costs of all risks, liability, claims, demands, or causes of action and damages which arise out of, or are in any way connected with any medical condition my Participant has whether or not I have previously disclosed that condition to Journeymen.
I give my permission for Journeymen and/or its agents to use without limitation or obligation, photographs, film footage, or tape recordings, which may include Participant’s voice or image for promotional purposes.
I have sufficient opportunity to read and understand this entire document. I have read and understood it. I agree to be bound by all of its terms.

En consideración de los servicios del Journeymen Institute, incluidos todos sus oficiales, directores, personal, líderes, colíderes, voluntarios, afiliados y todas las personas y entidades que actúan para ellos o en su nombre (en adelante, colectivamente denominados “Journeymen”), el derecho mío, de mi hijo/a, hijo/a de crianza o joven adolescente bajo mi custodia legal (en adelante “Participante”), y el derecho de mi Participante a participar en este Curso o evento (en adelante “Curso”), por la presente acepto libre y voluntariamente liberar, indemnizar y eximir de responsabilidad a Journeymen en mi nombre, en el de mi Participante, mis hijos, mis padres, mis herederos, cesionarios, representantes personales y patrimonio, como sigue:
DIVULGACIÓN Y RECONOCIMIENTO DE RIESGOS
Entiendo que el Curso es un curso de crecimiento y desarrollo personal realizado principalmente en un entorno al aire libre, con exposición adicional a entornos urbanos, suburbanos y/o silvestres, y que implica riesgos conocidos y no anticipados que podrían resultar en lesiones físicas o emocionales, parálisis, muerte, enfermedad o daños a mí, a la propiedad o a terceros. Entiendo que dichos riesgos simplemente no pueden eliminarse sin poner en peligro las cualidades esenciales de la actividad. Estos riesgos incluyen, entre otros:
La naturaleza misma de este Curso, que implica o puede implicar:
Actividad física, mental, emocional e intelectual intensa y vigorosa, como juegos al aire libre o en interiores durante el día o la noche, juegos de rol (por ejemplo, representaciones de eventos pasados, sentimientos o partes de la psique o personalidad) y ejercicios y procesos que pueden incluir o resultar en estrés físico, mental o emocional, angustia y fatiga (por ejemplo, enfrentar y superar obstáculos físicos, emocionales o mentales para lograr metas);
La posibilidad de muerte; lesiones al sistema musculoesquelético (como distensiones, fracturas, rupturas, moretones, pérdida de extremidad o de uso de extremidad, paraplejía o cuadriplejía), a órganos internos, al sistema cardiovascular (como presión arterial elevada, pulso elevado, ataque cardíaco, aneurisma, hemorragia o derrame cerebral), a ojos u oídos (pérdida de la vista o el oído), al cuerpo (como raspaduras, cortes, perforaciones, laceraciones) y a la salud mental (como depresión o retraumatización relacionada con historial psicológico previo);
Riesgos asociados con el entorno al aire libre, campamentos y áreas silvestres tales como, pero no limitados a, “actos de la naturaleza” (derrumbes, relámpagos, etc.), clima adverso, interacciones con fauna silvestre; y
La posibilidad de cambios en relación con asuntos como: educación, carrera, empleo o negocio; relaciones con familia, amistades, jóvenes, compañeros de trabajo; y comportamiento en entornos sociales, personales, escolares o laborales.
Riesgos adicionales incluyen:
Los actos u omisiones de Journeymen, quienes pueden, entre otras cosas, desconocer la condición física o habilidades de cualquier participante; juzgar mal el clima, los elementos o el terreno; o dar instrucciones, advertencias o consejos inadecuados.
Defectos latentes o aparentes o condiciones en el equipo o propiedad proporcionados por Journeymen u otras personas o entidades, así como el uso u operación de dicho equipo.
Actos de otros participantes en el Curso u otras personas.
COMPROMISOS DEL PARTICIPANTE
Yo y mis representantes reconocemos, aceptamos y prometemos asumir todos los riesgos existentes en este Curso, incluidos los mencionados anteriormente así como aquellos no específicamente enumerados.
Yo y mis representantes entendemos, reconocemos y declaramos que mi participación y la de mi Participante en el Curso y en cada una de sus partes es completamente voluntaria y autorizo a mi Participante a participar a pesar de, y con pleno conocimiento de, todos los riesgos. Reconozco que en todo momento mi Participante será libre de abandonar el Curso o de no participar en alguna parte o en la totalidad del Curso.
Yo y mis representantes autorizamos a Journeymen a tomar todas las medidas razonables en nombre de mi Participante en caso de cualquier lesión física u otra lesión, enfermedad o condición que pueda sufrir durante el Curso. Por la presente, autorizo a Journeymen a aplicar primeros auxilios de emergencia, contratar médicos de cualquier tipo, servicios de enfermería, ambulancia, paramédicos u otros servicios o personal que, a su exclusivo criterio, sean considerados razonables y necesarios para la atención inmediata, salud y seguridad de mi Participante.
Yo y mis representantes por la presente liberamos voluntariamente y descargamos para siempre a Journeymen y aceptamos indemnizar y eximirlos de toda responsabilidad, reclamaciones, demandas o causas de acción y daños que surjan de, o estén relacionados de cualquier manera con, la participación de mi Participante en el Curso, el uso de equipo o instalaciones de Journeymen por parte de mi Participante, o la prestación por parte de Journeymen de servicios de emergencia, incluidos pero no limitados a reclamaciones que aleguen actos u omisiones negligentes o mala práctica médica.
Yo y mis representantes también liberamos y descargamos para siempre a todos los lugares donde se realiza el Curso (“Sedes”) y aceptamos indemnizar y eximir a las Sedes de toda responsabilidad, reclamaciones, demandas o causas de acción y daños que surjan de, o estén relacionados de cualquier manera con, la participación de mi Participante en el Curso o el uso por parte de mi Participante del equipo o instalaciones de las Sedes.
Acepto y prometo indemnizar y eximir de responsabilidad a Journeymen de todos los costos y responsabilidades incurridos por Journeymen en relación con reclamaciones por lesiones personales o daños a la propiedad de personal, otros participantes, voluntarios, espectadores u otros terceros que surjan de, o estén relacionados de cualquier manera con, mi participación o la de mi Participante en el Curso.
Además, acepto y prometo indemnizar y eximir de responsabilidad a las Sedes de todos los costos y responsabilidades, incluidos, entre otros, honorarios de abogados, incurridos por las Sedes en relación con reclamaciones por lesiones personales o daños a la propiedad de personal, otros participantes, voluntarios, espectadores u otros terceros que surjan de, o estén relacionados de cualquier manera con, mi participación en este Curso.
Al firmar este documento, reconozco y acepto plenamente que si alguien (incluyéndome a mí) resulta herido o si la propiedad es dañada, perdida o destruida como resultado de la participación de mi Participante en el Curso, un tribunal de justicia podría determinar que he renunciado a cualquier derecho que pudiera tener para presentar una reclamación o demanda contra Journeymen.
Si Journeymen o cualquier persona actuando en su nombre incurre en honorarios de abogados y costos en relación con cualquier esfuerzo por hacer cumplir este acuerdo como resultado de la participación de mi Participante en el Curso, acepto y prometo indemnizar y eximirlos de todos esos honorarios y costos.
Certifico que cuento con seguro médico, de accidentes y de responsabilidad suficiente para cubrir los costos y gastos de cualquier lesión o daño que mi Participante pueda sufrir o causar mientras participa en el Curso. Si no cuento con dicho seguro, acepto asumir todos los costos de dichos gastos y responsabilidades.
Certifico que he completado los formularios de inscripción requeridos por Journeymen, si se me proporcionaron; que he revelado cada una de las condiciones físicas, emocionales o mentales por las que mi Participante ha recibido tratamiento o está recibiendo tratamiento actualmente; que la información que he proporcionado sobre la condición física, emocional o mental de mi Participante es completa y verdadera; y que he cumplido con los requisitos médicos de Journeymen. Además, certifico que mi Participante no tiene ninguna condición médica que pueda interferir con su seguridad en el Curso y acepto asumir y soportar los costos de todos los riesgos, responsabilidades, reclamaciones, demandas o causas de acción y daños que surjan de, o estén relacionados de cualquier manera con, cualquier condición médica que tenga mi Participante, haya sido o no previamente revelada a Journeymen.
Doy mi permiso para que Journeymen y/o sus agentes utilicen sin limitación u obligación, fotografías, grabaciones de video o audio que puedan incluir la voz o imagen del Participante con fines promocionales.
He tenido suficiente oportunidad para leer y comprender este documento completo. Lo he leído y entendido. Estoy de acuerdo en quedar obligado(a) por todos sus términos.
